How to get out of a DUI in Tennessee (police don’t want you to know this)

But first…

What if you failed the sobriety test?

If you fail the sobriety test, does this mean you’re screwed and will 100% be found guilty?

First of all, don’t ever take a sobriety test again. Go read my article How to refuse a sobriety test. Why? Because when you take a sobriety test, you are literally giving the police evidence they can use against you. This means you are more likely to be found guilty of a DUI. 

But for now, let’s assume you took the sobriety test and failed it. Take a deep breath. If you have a skilled defense attorney with experience fighting DUI’s, you will not necessarily be found guilty.  

The points below are how skilled defense attorneys get DUI’s thrown out – even if you failed the sobriety test.


How to Get out of a DUI in Eastern Tennessee

If you’re found guilty of driving under the influence in Eastern Tennessee, the DUI will stay on your record for your entire life. You do not have to resign yourself to this fate. Here are four effective ways to make sure you get out of a DUI so it never makes it onto your record: 



  1. Look for mistakes the cops made. 

You’d be surprised how many times the police mess up in these cases. Often, police arrest people for DUIs without grounds to do so, or they don’t allow you to call the lawyer of your choice. Whatever the mistake is, it can result in the case getting thrown out. 

2. Don’t prove either way that you were actually driving. 

If the cop doesn’t have any evidence you were ACTUALLY driving, this case can get thrown out. This is why I always tell people to never sit in the driver’s seat (especially with the keys in the ignition) if the cops could have any suspicion that you’ve been drinking. 

Now, this one might be hard to prove if the cop, you know… pulled you over. But if you were parked, this one’s a lot easier to argue. 

3. Challenge the integrity/accuracy of the sobriety tests 

The machines police use are not perfect and make mistakes all the time. According to the DWI Guys in New York, “Scientific studies show that breathalyzers have a 50% margin of error when compared to blood tests. A whole host of factors affect a breathalyzer BAC reading, including age, gender, rate of consumption, medication, and emotional state.”

Field sobriety tests aren’t accurate either. For example, the accuracy of a one-leg stand test is only 65%, the walk-and-turn is 68%, and the accuracy rate of the horizontal gaze nystagmus is only 77%. In fact, it’s possible to fail these while sober. 


And MOST IMPORTANTLY – 

4. Get yourself a defense lawyer who is experienced with fighting and beating DUI charges.
